Tampa Judge Postpones Decision on Same-Sex Divorce Case

Tampa, FL – Circuit Judge Laurel M. Lee postponed making a decision on Thursday that would allow a lesbian couple to divorce, reports the Tampa Bay Times.

Judge Lee told attorneys who are representing Mariama Changamire Shaw, 47, and Keiba Lynn Shaw, 45, to come back at a later date, which some are speculating could challenge Florida’s ban on same-sex marriage.

“This is obviously a significant and important legal argument for your clients,” Judge Lee told the attorneys, “and one that I want you to have every opportunity to argue before the court.”

Married four years ago in Massachusetts, the couple relocated to Florida in 2011. They separated in October, and filed for divorce on January 15. The settlement agreement, part of a collaborative divorce proceeding, was worked out in March.

“We should not be as a state discouraging people from moving to Florida because once here they are forever married,” said Attorney Ellen Ware, one of the two lawyers representing Changamire Shaw. “Essentially by refusing to divorce people, we are telling them if they move here they are stuck.”
